OFFICIAL RULES – 2009 DoGooderTV Nonprofit Video Awards CONSUMER DISCLOSURE: NO MEMBERSHIP, PURCHASE, OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. 1. The Contest: Submit videos, animations, and mash-ups from nonprofit organizations or in support of a nonprofit organization used to engage constituents and make the world a better place. 2. Agreement to Rules: By entering this contest, you agree to all of these Official Rules. All decisions regarding the contest will be made by "The Partners"* in its sole discretion, and are final. 3. Eligibility: This contest is open only to nonprofit organizations and their constituents. Not valid where prohibited. Employees, officers or directors of "The Partners" are not eligible. 4. Originality and Rights: ALL ENTRIES MUST HAVE BEEN RELEASED IN 2008. By submitting your video, you are promising that you own all rights to all material in your video, including the music, images, script, and rights to include all persons, places or organizations included or depicted. Include your name, year and copyright on your work, as you will retain all rights to your entries. "The Partners" will have distribution rights for non-commercial use, and videomakers will have co-distribution rights for either public or commercial use. You also agree to allow "The Partners" to use your name, or your organization's name, identification, and likeness to use, promote or publicize your video in any manner, without limitation, and without further compensation. You agree to indemnify "The Partners", including for legal costs, against any challenges to the ownership, use of, or rights to material in your video. 5. What Your Video May Contain: "The Partners" intend to use these videos to show how nonprofit organizations are using technology to inspire and engage constituents. Video content should be informative, educational and entertaining, as well as original. 6. Content Limitations: Entries that are lewd, obscene, pornographic, disparaging of "The Partners" or of another nonprofit organization or otherwise contain objectionable material may be disqualified in "The Partners'" sole and unfettered discretion. 8. SELECTION OF WINNERS: Round 1: Submissions will be judged by a qualified panel of judges ("Judges") who will evaluate each eligible Submission based on the judging criteria (defined in Rule 7 above), and the top ten (10) entries will be designated as the Finalists. Limit one (1) Finalist entry per organization or individual. Round 1 judging will be completed on/about 3/26/09. Round 2: The ten (10) Finalists submissions will be revealed on the Web Site on/about 4/6/09. The Finalists’ Submissions will be posted for the NTEN community to vote on their favorite at http://www.dogooder.tv ("Web Site") starting on/about 4/6/09 and ending on 4/26/09 ("Voting Period"). Limit one (1) vote per person. At the close of the Voting Period, the Submission that receives the most votes will be declared the Grand Prize Winner. The Submission with the next highest vote total will be declared the Runner-Up Winner, and the next highest vote total will be Third Place Winner. In the unlikely event that public voting results in a tie, "The Partners" will decide the winner based on their scoring in the first round. At the discretion of "The Partners", there may be additional categories and honors related to those categories. All Finalists, Grand Prize, Runner-Up and Third Place Winners are subject to verification, including without limitation, verification of eligibility, compliance with these Official Rules and completion of all required documents (described below). Entrants agree that "The Partners" have the sole right to decide all matters and disputes arising from this Contest and that all decisions of "The Partners" are final and binding. 9. To Enter the Contest: The contest Submission Period starts January 26, 2009 and ends at 11:59 pm EDT on March 26, 2009. Entry is a two-part process; YOUR ENTRY IS NOT FINAL UNTIL BOTH STEPS ARE TAKEN AND YOU HAVE RECEIVED AN E-MAIL CONFIRMATION OF YOUR ENTRY FROM "The Partners". (1) First, you must submit your video entry to "The Partners" Competition Page on DoGooderTV, by visiting www.dogooder.tv and uploading your video at http://www.dogooder.tv/nonprofitvideoawards_signup. You will have to comply with all terms, conditions and registration requirements of DoGooderTV. (2) Once your video has been uploaded and approved for viewing, DoGooderTV will provide you a link to your video. You can then visit the contest registration page at http://www.dogooder.tv/nonprofitvideoawards, complete the entry form, and agree to the contest rules. Your entry is not complete until you have received an e-mail acknowledging your entry; if you do not receive an e-mail within five days of your entry, please contact DogooderTV at nonprofitvideoawards@dogooder.tv . 10. Prizes: Grand Prize: "The Partners" will award one all expense paid trip to the 2009 NTC in San Francisco. Winners will be announced at the NTC on April 26, 2009 and will be notified by email shortly thereafter. Winners must execute final releases and information requests prior to award of the prizes. Failure to respond to the information requests or otherwise timely comply with all rules or requests from "The Partners" will void the award, and the prize may then be awarded to another entrant. 11. Additional Conditions and Terms: As a condition for entry, you agree to release, waive, indemnify, and otherwise hold harmless "The Partners" and all persons associated with it from any liability associated with your video and this contest to the fullest extent of appropriate state or local laws. (A) All taxes are the responsibility of the winner. (B) You agree to comply with all government laws and regulations. (C) ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, "The Partners" RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. (D)"The Partners" are not responsible for errors of any kind, technical hardware or software failures of any kind, including any injury or damage to any person's computer, related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit your ability to participate in the promotion. (E) "The Partners" reserve the right to cancel or modify the contest if fraud, misconduct or technical failures harm the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by "The Partners", in their sole discretion. In the event of termination, a notice will be posted online. If insufficient entries are received, or if no entry submitted meets minimum reasonable criteria for a prize, in "The Partners" sole and final discretion, a Grand Prize winner may not be selected. If at least one qualifying entry is made, at least one finalist award will be made. (F) Proof of submitting entries or responses to inquiries will not be deemed to be proof of receipt by "The Partners". Only receipt of an e-mail from "The Partners" acknowledging an entry or communication will be considered proof of submission. (G) Any use of robotic, automatic, programmed or like methods of participation will void all such submissions by the entrant. (H) "The Partners" reserve the right to prohibit the participation of an individual if fraud or tampering is suspected or if the account holder fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. (I) Once submitted, an entry is final and may not be altered or edited further. Duplicate entries will disqualify all such entries. (J) No submissions will be returned. (K) "The Partners" may use any and all information obtained from entrants for its internal activities, including contacting an entrant. "The Partners" may share this information with others, but will not sell this information to others. (L) This Contest is offered only in the United States and is governed by the laws of the State of Illinois. All claims relating in any manner to this contest or to any submission must be resolved in the federal or state courts of Cook County, Illinois. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of participants and "The Partners" in connection with the contest, shall be governed by and construed in accordance with the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Illinois. (M) "The Partners" are not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user's own risk. (N) The odds of winning will be determined by the number of entries. (O) Videos cannot be longer than ten minutes. (P) Project may be executed and submitted by an individual or a group – for communications purposes, please identify one person as the team representative and note on the entry form.
